The Promotion is governed by these Official Rules, which are available online at https://www.footlocker.ca/contest and at Foot Locker 1067 Robson Street, Vancouver, BC V6E 1A9 between Wednesday September 15^th 2021 and Friday October 6^th ,2021.  By participating in the Promotion, each entrant agrees to these Official Rules, including all eligibility requirements, and understands that the results of the Promotion are final in all respects.  The Promotion is subject to all federal, provincial, and local laws and regulations and is void where prohibited by law.

ELIGIBILITY:

The Promotion is only open to legal residents of Vancouver, in the Province of British Columbia (excludes all other Provinces), who are thirteen (13) years of age or older at the time of entry. Employees, representatives, officers and directors, and those with whom they are domiciled, of Foot Locker Canada Co. (the “Sponsor”), prize suppliers, and advertising/promotion agencies and their respective parent companies, subsidiaries, affiliates, (all of the above, collectively, “Promotion Entities”) are not eligible to enter or win.  Sponsor reserves the right to verify the eligibility of the winner.  Winner must be able to travel to Vancouver, British Columbia to obtain prize, on a date agreed upon by Contest Sponsor and Winner (but in any event on or before Saturday October 23^rd,2021, failing which Winner will forfeit their prize). Sponsor is not liable for any accidents or injuries sustained during travel. Furthermore, Sponsor is not responsible for travel costs, the winner must arrange their own travel methods to claim their prize.

PROMOTION PERIOD:

The Promotion begins at 10:00 a.m. (PST) on Wednesday September 15^th 2021 and ends at 8:00 p.m. (PST) on Wednesday October 6^th 2021 (the “Promotion Period”). 

HOW TO ENTER:

NO PURCHASE NECESSARY to enter this Promotion.

There are two (2) ways to enter:

(i)                  Eligible entrants can obtain an entry ballot by making a purchase of any Vans product during the Promotion Period at Foot Locker located at 1067 Robson Street, Vancouver, BC V6E 1A9. The entry ballot must be completed and submitted in the in-store ballot box.

(ii)                Eligible entrants can also enter by hand printing on a plain piece of 3”x5” paper their first and last name, street address (no P.O. Boxes), city, province, postal, e-mail address (optional) plus daytime and evening telephone numbers including area code and mailing in an envelope with sufficient postage affixed, to “Foot Locker Vancouver Contest”, 230 Barmac Drive, 2^nd floor, Weston, Ontario M9L 2Z3. Mail in entry must be postmarked during the Promotion Period and received by Tuesday October 10^th at 8:00 p.m (PST) 2021.

 

Photocopies, facsimiles or other reproductions of the entry ballot will not be eligible. 

The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Promotion. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Promotion will be the Promotion server machine(s). All entries become the property of the Sponsor and none will be returned. All decisions of the Sponsor are final and binding.

 

By entering, you agree as follows: (i) you acknowledge that your entry may be used in Sponsor’s promotional material or on Sponsor’s social media accounts, in Sponsor's sole discretion but without obligation; (ii) you have the right and authority to, and do hereby, grant to Sponsor an irrevocable, non-exclusive, royalty-free worldwide license in perpetuity to reproduce, store, copy, broadcast, display, distribute, edit, alter, combine with other material, publish, post, commercialize and/or otherwise use without limitation all or any part of the entry on the Promotion website or in Sponsor’s promotional material and social media accounts; (iii) you waive any and all moral rights that you may have in and to the entry with respect to the uses contemplated herein; and, (iv) you agree to release and hold harmless Sponsor from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relates in any way to Sponsor’s use of the entry.

PRIZES: There is a total of one (1) Grand Prize available to be won.

Grand Prize:

The Grand Prize consists of one (1) SE Bikes Vans Big Ripper 29” BMX bike The prize may not be transferred and must be accepted as awarded.  The winner may not request cash or a substitute prize. The total Grand Prize is valued at approximately nine hundred and forty-nine dollars and ninety-nine cents in Canadian dollars ($949.99 CAD).

Any costs or expenses incurred by the winner in claiming or using their prize will be the responsibility of the winners. Sponsor reserves the right to substitute (in whole or in part) a prize of equal or greater value if stated prize becomes unavailable.

The following general conditions apply to the Prize:  (i) the Sponsor and/or their representatives reserve the right at any time to place reasonable restrictions on the availability or use of the Prize or any aspect of the Prize; (ii) by accepting the Prize, the winner agrees to waive all liability against the Promotion Entities, and all of their respective officers, directors, employees, representatives, subsidiaries, affiliates, agents, and agencies affiliated with this Promotion (collectively, the “Releasees”), if any part of the Prize does not prove satisfactory, either in whole or in part, and from any injury, loss or damage of any kind resulting from the acceptance, use, or misuse of the Prize, travel or activities related thereto, or otherwise from participation in the Promotion.

By entering this Promotion and accepting the Prize, the winner agrees to maintain his/her behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Promotion or Prize-related activity.  The Prize winner understands and agrees that Sponsor or prize providers have the right, in their sole discretion, to disqualify and remove the Prize winner if the Prize winner’s behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Promotion Entity or otherwise violates the policies of the prize providers, and in such a case, the Prize winner will still be solely responsible for all expenses related to the Prize.

PRIZE DRAW:

A random draw by a Foot Locker representative, from all completed eligible entry forms will be made on Wednesday October 13^th, 2021 by 06:00 p.m. PST in Vancouver, British Columbia. The chances of being selected are dependent upon the total number of eligible entries received.

 

WINNER NOTIFICATION AND SELECTION:

The potential Grand Prize winner will be contacted by phone. If a selected entrant cannot be contacted (or fails to respond to any direct message) within one (1) day of the Sponsor’s first attempt to contact such selected entrant, he/she will be declared ineligible, will forfeit any potential prize, and a new potential winner will be randomly selected from all remaining eligible entries in accordance with these Official Rules.   

Before being declared a Prize winner, the selected entrant: 1) will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question; 2) may be required to sign (and in the case of a minor, have his/her parent or legal guardian sign on his/her behalf) a Declaration and Release Form (the “Release Form”) stating that he/she has read, understood and complied with these Official Rules (including the eligibility requirements) and releasing the Releasees from any and all liability of any kind arising out of the selected entrant’s participation in this Promotion and receipt, use or misuse of the Prize ; 3) must grant all consents required as contemplated in these Official Rules; 4) must authorize the Sponsor to broadcast, publish and disseminate his/her name, address (city and province), photograph, likeness and voice in connection with any promotion or publicity and/or for general news, entertainment and information purposes with no notice or compensation to the selected entrant; and 5) must accept the Prize as offered.

IMPORTANT: In the case the winner of the contest is under the age of majority in the province of British Columbia, a parent or guardian must be present when the winner travels to Vancouver, British Columbia to claim their prize.

If any selected entrant fails to correctly answer the mathematical skill-testing question, fails to execute and return the Release Form within the required time period of one (1) business day, is otherwise not in compliance with these Official Rules, or is unable or unwilling to comply with these Official Rules, the selected entrant will be deemed ineligible and will forfeit his/her Prize.  A new potential winner will then be randomly selected from all remaining eligible entries in accordance with these Official Rules.  However, no potential Prize winner will be selected after Monday October 18^th 2021 by 06:00 p.m. PST.

All decisions of the Sponsor with respect to any aspect of this Promotion, including without limitation, the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Promotion.

INDEMNIFICATION AND LIMITATION OF LIABILITY:

BY ENTERING THE PROMOTION, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE RELEASEES FROM ANY LIABILITY, DEATH, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ENTRANT’S PARTICIPATION IN THE PROMOTION AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON.  THE SPONSOR DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE OR ANY RELATED PRIZE ELEMENTS. THE SPONSOR IS NOT LIABLE FOR ANY EVENTS, ACCIDENTS, OR INJURIES OCCURRING DURING THE WINNER’S TRAVEL TO CLAIM THE PRIZE. THE SPONSOR WILL NOT COVER TRAVEL COSTS. WINNER MUST ARRANGE FOR THEIR OWN TRAVEL AND PAY FOR IT THEMSELVES.

THE RELEASEES DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM OR MOBILE DEVICE RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE PROMOTION.

GENERAL CONDITIONS:

The Releasees are not responsible for (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, postage due or illegible entries or Release Forms; or (ii) failure to receive entries or Release Forms due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient.

The Releasees will not be liable for any failure of any website, computerized, electronic or telephone network during the Promotion; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Sponsor for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network; or any combination of the above.

In the event of a dispute as to any entrant, the authorized account holder of the email address associated with the entry will be deemed to be the entrant.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  Each potential winner may be required to show proof of being the authorized account holder.

The Sponsor reserves the right, in its sole discretion, to cancel, withdraw, modify, amend or suspend this Promotion or to amend or modify these Official Rules in any way, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind (including, but not limited to, technical problems, computer viruses, bugs, tampering, unauthorized intervention, fraud, and technical failure), insufficient entries, any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Promotion as contemplated by these Official Rules, or for any other reason. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. No more than the stated number of prizes will be awarded. Subject to all applicable Canadian federal, provincial, and municipal laws and regulations, these Official Rules govern all aspects of the Promotion and are binding on all participants.

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Promotion-related materials, including, but not limited to the Promotion entry form, and/or point of sale, television, radio, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control.

PERSONAL INFORMATION AND PRIVACY:

By entering this Promotion, each entrant consents to the Sponsor’s and its agent’s collection, use and disclosure of entry information for the purposes of administering this Promotion in accordance with its privacy policy.
